These Terms of Service apply to your use of the SwS Motorsports website and to purchases made through SwS Motorsports. By accessing our website, placing an order, or purchasing our products or services, you agree to these Terms of Service.

1. Off-Road and Competition Use

Unless specifically stated otherwise, SwS Motorsports products are intended for off-road, racing, competition, show, or other non-highway use only.

Many aftermarket performance products may alter a vehicle's engine, emissions system, fuel system, induction system, exhaust system, or other components regulated by federal, state, provincial, or local law.

It is the customer's responsibility to determine whether a product is legal for use on their vehicle and in their location.

On-road legality varies depending on local laws, emissions regulations, vehicle classification, registration requirements, inspection requirements, and the specific manner in which a product is installed or used.

SwS Motorsports makes no representation that any product is legal for use on public roads unless that product is specifically identified as being approved or certified for such use.

The purchaser assumes responsibility for complying with all applicable laws and regulations.

2. Motorsports and Vehicle Modification Risk

Automotive modification and motorsports involve inherent risks.

Installation or use of aftermarket components may affect vehicle reliability, handling, braking, emissions, engine operation, drivetrain durability, safety systems, manufacturer warranties, or other vehicle systems.

By purchasing or using SwS Motorsports products, you acknowledge these risks and accept responsibility for the installation, configuration, maintenance, and operation of your vehicle.

SwS Motorsports is not responsible for damage, injury, loss, or expense resulting from improper installation, incorrect tuning, component incompatibility, misuse, racing, competition, vehicle modification, or operation beyond the limits of the vehicle or its components.

3. Installation and Professional Responsibility

Many SwS Motorsports products require mechanical knowledge, fabrication, machining, wiring, tuning, or other specialized skills.

Unless otherwise stated, installation should be performed by a qualified individual familiar with the vehicle and components involved.

The purchaser is responsible for verifying:

• Proper fitment

• Fastener torque and installation

• Belt alignment and clearance

• Fuel system compatibility

• Engine management and calibration

• Cooling system requirements

• Adequate hood, chassis, and component clearance

• Safe operation of the completed vehicle

Modification of a vehicle from its factory configuration can create conditions that SwS Motorsports cannot reasonably anticipate.

4. Product Fitment

We make every reasonable effort to provide accurate product descriptions and fitment information.

However, aftermarket vehicles frequently contain combinations of engines, cylinder heads, accessories, intake systems, body components, engine mounts, transmissions, and other modifications that differ from factory configurations.

Fitment information should therefore be treated as guidance unless a specific configuration is expressly guaranteed.

Minor modification, clearancing, fabrication, machining, or adjustment may be required for some applications.

It is the customer's responsibility to verify that a product is appropriate for their intended application before installation.

5. Product Development and Design Changes

SwS Motorsports continually develops and improves its products.

Production components may contain minor design, manufacturing, cosmetic, hardware, or dimensional changes from photographs, prototypes, previous production runs, promotional materials, or earlier versions of a product.

These changes may be made without notice when they do not substantially affect the intended function of the product.

6. Orders and Payment

By placing an order, you agree that the information you provide is accurate and that you are authorized to use the selected payment method.

We reserve the right to refuse, limit, or cancel any order.

If we cancel an order that has already been paid for and no non-refundable work or service has been performed, the applicable amount will be refunded.

Pricing, availability, specifications, and product descriptions may be corrected if an error is discovered.

7. Pre-Orders and Production Lead Times

Some SwS Motorsports products are produced in small batches, manufactured to order, or offered through pre-orders.

Any production, fulfillment, or delivery date provided is an estimate and not a guaranteed delivery date.

Manufacturing delays may occur because of material availability, supplier delays, machining schedules, casting, fabrication, shipping, quality-control issues, design revisions, or other circumstances outside our direct control.

We will make reasonable efforts to communicate significant delays.

8. Cancellations

Standard orders may generally be canceled before they have been processed, shipped, or entered into production.

Pre-orders, made-to-order products, custom products, machining services, or other products requiring materials or labor may become non-cancelable or subject to a cancellation fee once materials have been purchased or work has begun.

Any deposits, design fees, disassembly fees, or other charges specifically identified as non-refundable at the time of purchase remain non-refundable.

Orders that have already shipped cannot be canceled and must instead be handled under our Return and Refund Policy.

9. Returns and Exchanges

Eligible returns are subject to our posted Return and Refund Policy.

Unless otherwise stated, accepted returns are subject to a 15% restocking fee.

Eligible items may also be exchanged for another product. Customers are responsible for applicable return and replacement shipping costs unless the exchange is necessary because of an error by SwS Motorsports.

Returned merchandise must meet the conditions specified in our Return and Refund Policy.

Custom, modified, machined, used, installed, or specially manufactured items may not be eligible for return.

10. Shipping

Shipping dates and carrier delivery estimates are not guaranteed.

SwS Motorsports is not responsible for delays caused by shipping carriers, weather, customs, incorrect customer-provided addresses, or other events outside our control.

Customers are responsible for providing an accurate and deliverable shipping address.

Any visible shipping damage should be documented as soon as possible so that a carrier claim can be filed when applicable.

11. Warranty

Unless a specific written warranty is provided with a product, SwS Motorsports products are sold subject to the warranties, if any, stated on the applicable product page.

Warranty coverage does not include damage resulting from:

• Improper installation

• Improper tuning or calibration

• Detonation or engine failure

• Overheating

• Overspeed or over-boost conditions

• Misuse or abuse

• Racing or competition damage

• Modification of the product

• Incorrect application

• Normal wear

• Failure of another vehicle component

Third-party products may be covered solely by the original manufacturer's warranty.

12. Limitation of Liability

To the fullest extent permitted by applicable law, SwS Motorsports shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the purchase, installation, modification, or use of our products or services.

This includes, without limitation, damage to an engine, transmission, drivetrain, vehicle, property, loss of vehicle use, lost profits, towing expenses, labor expenses, racing expenses, or other consequential losses.

The purchaser assumes responsibility for determining whether the selected components, installation, tuning, and vehicle configuration are safe and appropriate for the intended use.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

13. Assumption of Risk

By purchasing, installing, or using performance automotive components, the purchaser acknowledges that modified vehicles and motorsports activities can result in property damage, serious bodily injury, or death.

The purchaser voluntarily assumes the risks associated with the installation and use of the products.

Vehicle operation should always be conducted in a safe manner and in accordance with applicable laws and regulations.

14. Intellectual Property

Unless otherwise stated, content on the SwS Motorsports website—including product designs, photographs, graphics, logos, written content, illustrations, videos, product names, and other materials—is owned by or licensed to SwS Motorsports.

Website content may not be reproduced, distributed, sold, or used commercially without permission except where otherwise permitted by law.

Purchasing a physical product does not grant ownership of any associated intellectual property, design rights, trademarks, copyrights, or other proprietary rights.

15. Website Information

We attempt to ensure that information presented on our website is accurate, but typographical errors, outdated information, incorrect pricing, technical inaccuracies, or omissions may occasionally occur.

We reserve the right to correct errors and update website content without prior notice.

Photographs and renderings may be representative and may not depict every production variation.

16. Third-Party Products and Links

Our website may contain products manufactured by third parties or links to third-party websites, manufacturers, resources, or services.

SwS Motorsports does not control third-party websites and is not responsible for their content, policies, availability, or practices.

References or links to third parties do not necessarily constitute an endorsement.
